What personal data will RBGE collect?

Ten artworks will be selected by the Scottish Ballet and RBGE who will then select their winners from the ten. Each artwork contains the name of the pupil, the age category and the school, as attached by the teacher submitting the work to the art competition.

Legal basis for processing

By accepting the terms and conditions of the Art competition organised by the National Galleries of Scotland and with the terms and conditions of the RBGE, participating schools and nurseries are entering into a contract with the RBGE. Data of the winners provided by schools and nurseries to NGS and subsequently provided to RBGE will be processed by us in relation to the selection of prize winners and notifying the appropriate schools and nurseries is undertaken to fulfil that contract.

Any publication or other use of winners’ names and or images in photography, video etc. will be on the basis of consent.

Sharing personal data

Your data will be handled by a limited number of RBGE staff for selecting prize winners, notifying winners and arranging the workshop and arranging membership.

With parental permission, images of prize winners will be published in promotional material, including online.

How long will we keep the data?

Winners’ names and images that have been published will continue to be kept indefinitely.

Your rights over access to the data we hold on you

Where you have given consent for us to use you or your child’s personal data, you can withdraw consent for any future processing at any time.

Subject to some legal exceptions you have statutory rights relating to your own personal data:

  • Access – you have the right to know what data we hold relating to you and why, and to receive a copy of it;
  • Rectification – you have the right to have inaccurate information about you corrected;
  • Objection – you have the right to object to RBGE using your information, and we would have to stop unless we have a sound overriding reason to continue;
  • Erasure, restriction and portability – in specific circumstances, you have the right to have your personal data deleted, to put limits on what RBGE may do with it or to receive a copy in machine-readable form to take to another organisation;
